Grow Terms & Support

These Terms & Support govern access to and use of the Grow Smart SA website, training programmes and related services provided by Grow Smart SA (Pty) Ltd. These terms are intended as a practical starting point and are not legal advice. They should be reviewed by a South African legal professional before being relied upon as the final contractual terms.
1. Programme bookings
By booking a Grow Smart SA training programme or session, whether as an individual educator, school, institution or sponsored cohort, you agree to the pricing, inclusions and programme details displayed on this website or otherwise confirmed at the time of booking.
The applicable programme description will specify, where relevant, the number of sessions, intended participants, deliverables, support period and other inclusions.
Grow Smart SA reserves the right to update programme offerings and pricing from time to time. Any changes will not affect a booking that has already been confirmed unless otherwise agreed with the customer.
2. Payments
Payment arrangements will be communicated at the time of booking and may include payment by electronic transfer, invoice or another payment method made available by Grow Smart SA.
For schools, institutions or sponsored cohorts, payment and invoicing arrangements may be agreed in writing before the programme begins.
Where applicable, cancellation, postponement, rescheduling and refund arrangements will be communicated as part of the booking or service agreement.
Nothing in these terms is intended to exclude or limit any right or remedy that a consumer may have under applicable South African law.
3. Intellectual property
Unless otherwise stated, all original Grow Smart SA materials, including templates, guides, prompt libraries, training resources, frameworks, graphics and other programme materials, remain the intellectual property of Grow Smart SA (Pty) Ltd or its relevant licensors.
Participants are granted a limited, non-exclusive right to use materials supplied as part of a Grow Smart SA programme for their own personal educational or school-related purposes.
Unless Grow Smart SA has given written permission, programme materials may not be resold, commercially redistributed, reproduced for commercial use, published as a competing resource, or represented as the participant's own intellectual property.
This does not prevent participants from using their own work, examples, adaptations or teaching materials created independently using general concepts learned during a Grow Smart SA programme.
4. Support
Post-programme support is provided for the period expressly stated in the applicable package or booking, including 30 or 60 days where applicable.
Support is provided through the contact channels communicated by Grow Smart SA and is intended to assist with reasonable programme-related questions and implementation support.
Support periods do not constitute unlimited technical support, development services or a guarantee of response within a specific timeframe unless a separate service-level arrangement has been agreed in writing.
5. Artificial intelligence and educational outputs
Grow Smart SA may use artificial intelligence and AI-assisted technologies as part of its products, training and services.
AI-generated or AI-assisted outputs may contain errors, omissions or inaccuracies. Users are responsible for reviewing, verifying and exercising professional judgement before relying on such outputs for teaching, assessment, academic, administrative or other decisions.
Grow Smart SA does not represent that every AI-assisted output will be complete, accurate, appropriate or error-free.
6. Limitation of liability
To the maximum extent permitted by applicable law, Grow Smart SA (Pty) Ltd will not be liable for indirect, incidental, special or consequential loss arising from the use of the website or services, including loss resulting from temporary service interruption, technical issues, loss of data or reliance on information or AI-assisted outputs.
Grow Smart SA will take reasonable steps to maintain the availability, security and functionality of its website and services but does not guarantee that the website or services will always be uninterrupted, error-free, secure or available.
Nothing in these Terms & Support excludes, restricts or limits any liability, right or remedy that cannot lawfully be excluded, restricted or limited under South African law.
7. Website and third-party services
The Grow Smart SA website may contain links to or rely on third-party platforms, technologies or services. Grow Smart SA is not responsible for the availability, content, security or performance of third-party services outside its reasonable control.
Users remain responsible for complying with the terms and policies applicable to any third-party services they choose to use.
8. Privacy
Personal information collected through this website or in connection with Grow Smart SA services will be handled in accordance with the Grow Smart SA Privacy Policy and applicable South African data-protection law.
Where personal information is collected through forms, bookings, enquiries or other interactions, users should review the Privacy Policy for information about how that information is processed.
9. Governing law
These Terms & Support are governed by the laws of the Republic of South Africa, subject to any mandatory rights or protections applicable to the user under South African law.
